These Terms of Service are subject to change, in any form or extent, with or without notice. All clients must read, understand and agree to all of the below terms before requesting a commission slot.

By sending payment via invoice, the client has agreed to the terms below.

Terms of Service

Invoices and commission discussion/communication will only be handled through email (ninjascreations@gmail.com) for record keeping purposes. 
Updates will be given and announced through Trello and email when needed. Public updates will be made on Twitter (ninjascreations). Clients are encouraged to reach out after a prolonged period between updates or if questions arise.
Emails will not be answered or sent on holidays, scheduled days off or during emergencies. If you do not receive a reply within 7 days, please resend it in the event it has been accidentally deleted or slipped through the cracks.

 
Prices, Payment and Refunds:
  1. Displayed prices may change due to character/commission complexity and type of commission.
  2. Up to date non-shaded reference and/or basic commission idea sketch must be provided. A quote and further discussion will be provided via email.
  3. Payment is to be paid in full via emailed invoice within 7 days before work on commission begins. Payment plans may be set up for commissions over $100. Once all payments, if any, are complete, the commission will be moved to the queue list.
  4. Payments must be paid in USD through Square or Stripe invoice. Any other forms of payment will not be accepted.
  5. Refund policy is as follows: If the client needs to cancel their commission BEFORE work begins, the Artist will retain 5% of the original payment (in USD). Canceling a commission during the sketch/thumbnail stage will result in a 50% refund of the original payment (in USD) No refund will be given if the client cancels during the color stage or after the commission has been completed. If the artist cancels the commission, 100% of the original payment will be refunded (in USD).
Cancellations, Critique/Redlines, Corrections, and Rejected Sketches
  1. Clients may cancel their commission in the event of unforeseen events, extensive wait times exceeding displayed estimated completion times or lack of updates/communication that have been unaddressed.
  2. The Artist may cancel any commission and refund the client due to poor communication, rude, hateful and inappropriate behavior, client is unable to communicate in clear/effective English or unforeseen inability to complete the commission.
  3. Critiques and redline corrections are included in commissions over $100 to ensure the best result. These may be rejected to retain the quality of the commission or style.
  4. Sketch corrections are available during the initial sketch stage. Only 3 revised sketches are allowed per commission. More than the provided revision will result in an additional fee. Color corrections may be made in regards to the reference image given at the coloring stage. Minor revision may be made to the final image before the images are posted or sent out to the client. Any additional fees will be invoiced before images are emailed to the client.
  5. Any sketches/thumbnails rejected by the client will be recycled for other commissions, personal works or YCH slots.
 
Unreachable Clients, Chargebacks, and Artwork Rights/Republication
  1. If a client is unreachable via email or other given contact for 3 months or more, the Artist reserves the right to cancel the commission and retain a 5% fee. If 6 months have passed and the client is still unreachable, a refund will not be issued. If the client remains unreachable for 1 year or more, the payment is void.
  2. Any chargebacks issued against me after the commission has been completed and approved will result in a block and ban from future commissions and other paid artwork.
  3. The Artist retains the rights to display all commissioned work on any personal website, gallery or journal. Time sensitive gifts may be delayed to the public at the request of the client.
  4. The Artist retains ALL the rights to the commissioned artwork, including the right to make any kind of merchandise and to make any alterations to make the commissioned artwork more generic for merchandise at my discretion. Image rights can be negotiated for an additional fee.
  5. The client retains all rights to their respective character(s). This does not allow them rights to the commission image.
  6. Clients may create up to 3 prints for personal use (home use or as gifts). Clients may also resize or crop the artwork to create icons, wallpapers or other merchandise for non commercial use only. The client may not alter the image itself. Clients may upload the low resolution, watermarked version to their personal website or gallery with a credit line linking back to me.
 
Will and will not draw, Rejection of Commission
  1. The Artist is a SFW (safe for work) artist only. Artistic nudity and light violence/gore will be handled on a case by case basis.
    1. No illegal activities
    2. No sexual themes or implied sexual activities
    3. No hateful, offensive, derogatory or the like
    4. No extreme gore, violence or the like
  2. The Artist reserves the right to reject any commission for any reason. The Artist is not obligated to give a reason for rejection. 
  3. Reasons include but are not limited to the following:
Invalid reasons for rejection:
  1. Ethnicity, religion, lifestyle, orientation
Valid reasons for rejection:
  1. Full slots, emergency, unforeseen events, harsh colors, humanoid character
Collaboration Commissions
  1. These are handled on a case by case basis and follow the same TOS above.
  2. Some terms may change in correlation with the other artist(s) specifications and TOS. Please read and understand the TOS of all participating artists and ask any question you may have regarding conflicting or differing terms.
AI, NFT, Crypto, ect
  1. No art that I create, paid, free or otherwise, is to be used for AI generation, NFTs, any form of Crypto or any other form of robotic art.
